Fair Housing Policy

What is the Fair Housing Act

The Fair Housing Act (42 U.S.C. 3601 et seq.) prohibits discrimination in the sale or rental of housing based on seven protected classes at the federal level: race, color, religion, sex, national origin, disability, and familial status. Many states add additional protections such as sexual orientation, source of income, marital status, and age.

What PropSlick Prohibits

  • - Statements of preference, limitation, or discrimination based on any protected class.
  • - Phrases such as "no children", "adults only", "Christian community", or "English speakers only".
  • - "No Section 8" or "no housing vouchers" where source of income is protected.
  • - Any coded language signaling a preference for or against a protected group.

Permitted Restrictions

Landlords may set a maximum occupancy based on square footage, require proof of income, require credit checks applied equally to all applicants, and prohibit smoking that applies to all.
